City Discusses Lawsuit

The Clayton City Council discusses the suit filed against the city of Clayton regarding wells hooked up at Stavemill Apartments at their monthly meeting Tuesday night.

The council took some action, first giving city attorney Mitch Baker permission to acknowledge the petition on behalf of each person named in their official capacity, as well as authorizing Baker to represent City Manager Cissy Henry in her individual capacity.

Baker made a recommendation to instruct the City Marshall to not write citations for the offense of discharging well water in the city’s sewer system until the ongoing litigation has been cleared up. A motion was made and passed unanimously. Baker explained the reasoning behind this recommendation.

“If the council didn’t vote to do that, it would probably be addressed through a request for an injunction on the part of the plantiffs, and I think this will help streamline the litigation process.”

Baker also recommended the council give him permission to file a counter claim should one be deemed appropriate. A motion was passed and passed unanimously regarding that recommendation as well.
