Tiger’s Attorney Explains Appeal

The town of Tiger filed a notice of appeal earlier this week in their suit with the city of Clayton about their sewage treatment rate.

As they move towards the actual filing of the appeal, Tiger’s attorney Allyn Stockton outlined the elements of the ruling that will be listed in their appeal.

Stockton said that one thing they will be appealing is a pre-trial ruling that decided whether or not the statute Clayton sued under applies to a contract between municipalities.

“Our argument was that was only between municipalities and private entities,” said Stockton. “We believe that exclusion does not apply to contracts for sewage treatment between one municipality and another.”

Stockton also said that the town of Tiger’s position is that the issue had been previously settled through other litigation.
