Clayton man convicted of shoplifting, sentenced to jail

A Rabun County jury found a Clayton man guilty of shoplifting from the local Walmart and as a result, the perpetrator was sentenced to serve time in jail for his crooked crime.

On Tuesday, Sept. 18, Judge Chan Caudell presided over the trial in the Superior Court of Rabun County in the matter of David Lee Frady. Assistant District Attorney Anthony Pickett represented the State in prosecuting Frady.

According to George Christian District Attorney of the Mountain Judicial Circuit Court, the theft occurred at WalMart when Frady and another individual shopped in the store during the early morning hours.

Frady and the other individual used a self-check aisle to purchase items, however Frady did not scan two of the items and left the store without paying for two items.

According to testimony at trial, Frady was barred from shopping at WalMart during late hours and was prohibited from using a self-check aisle as a condition of being allowed to shop at WalMart.

Video cameras captured the event and the jury was shown the video. In addition, the jury heard testimony from two State witnesses. Frady also testified.

Investigation of this theft was conducted by the local WalMart loss prevention staff. Frady was sentenced by Judge Caudell to 12 months probation, but required the first 4 months to be served in the Rabun County Detention Center.

The Court also imposed a $750.00 fine, ordered restitution, banished Frady from WalMart while under his sentence and required Frady to waive his Fourth Amendment Rights.
