Cities’ Responses to SPLOST Suit Filed

The responses of the other municipalities listed in the city of Clayton’s suit opposing the special purpose local option sales tax are starting to trickle in.

Attorney R. David Syfan filed the response of Tallulah Falls in Rabun County Superior Court at the end of last week.

Instead of responding to each individual claim listed in Clayton’s suit, Tallulah Falls’ response points to Rabun County’s response, saying they adopt and incorporate by reference the county’s defenses against the suit.

Tallulah Falls response does state that they specifically deny paragraph 81 in the city of Clayton’s suit, which alleges that the intergovernmental agreement violates Georgia Code in that they fail to list a specific dollar amount for each project in Tallulah Falls.
