Jury Decides in Clayton/Tiger Case

The jury has made a decision regarding a suit involving two Rabun County Cities.

The city of Clayton filed for a declaratory judgment against Tiger regarding the formula used to arrive at the cost of treating sewer.

In the suit, the City of Clayton alleged that Tiger was paying less than the cost to treat the sewage. Clayton alleged that paying no less than the cost of sewage is a provision in the law which allows for an agreement to run for fifty years instead of two years.

The three day trial ended with the jury deciding that the town of Tiger had been paying less than cost for some time, and Clayton City Attorney Mitch Baker said that the ruling provides clarity in this matter.

“I’m pleased with the outcome,” said Baker. “I feel like it reflects the hard work and dedication that’s been put in by city of Clayton employees and council members, and I feel like it provides some clarity moving forward for both the city of Clayton and the town of Tiger.”

The jury did not award attorney’s fees to the city of Clayton.
